01 — Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of OnyxCAD, operated at onyxcad.com ("the Service"). By creating an account or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

02 — The service

OnyxCAD provides a browser-based tool that allows users to:

— Upload STEP files and view them in a 3D browser viewer.
— Annotate individual faces of a 3D model with tolerances, thread specifications, colours, and notes.
— Export annotated STEP files with metadata embedded in the file structure.
— Generate shareable read-only links to annotated models for viewing by third parties without an account.

The number of active projects available to you at any time depends on your subscription plan. An "active project" is a STEP file and its associated annotations that is currently accessible for editing and sharing. You may archive projects to free up active slots — archived projects retain all data but their share links are paused until restored.

03 — Accounts

You must create an account to use OnyxCAD beyond the free tier. You are responsible for:

— Maintaining the confidentiality of your account credentials.
— All activity that occurs under your account.
— Ensuring the email address associated with your account is accurate and accessible.

You must be at least 18 years old to create an account. You may not create an account on behalf of another person without their consent.

We reserve the right to suspend or terminate accounts that violate these Terms.

04 — Subscriptions and payment

OnyxCAD offers the following subscription plans:

— Starter (Free): 3 active projects, no share links.
— Pro: price as displayed at onyxcad.com/pricing at the time of purchase. Includes up to 10 active projects and share links.
— Growth: price as displayed at onyxcad.com/pricing at the time of purchase. Includes up to 50 active projects and share links.

Payments are processed by Polar.sh. By subscribing, you also agree to Polar.sh's terms of service. Subscription fees are charged in advance on a monthly basis.

Refunds: We do not offer refunds on subscription payments. When you cancel a subscription, you retain access to paid features until the end of your current billing period, after which your account reverts to the free tier. Your data is not deleted on downgrade.

Cancellation: You may cancel your subscription at any time through the billing section of your OnyxCAD account, which links to our payment processor's customer portal. Cancellation takes effect at the end of your current billing period — you will not be charged for any subsequent period. You will retain access to all paid features until the end of the period you have already paid for. Your data is not deleted upon cancellation — your account reverts to the free tier and your projects remain accessible subject to free tier limits.

We reserve the right to change subscription pricing with 30 days' notice. If you do not cancel before the price change takes effect, your continued use constitutes acceptance of the new price.

05 — Your content

You retain full ownership of all STEP files and annotation data you upload or create using OnyxCAD ("Your Content").

By uploading content to OnyxCAD, you grant us a limited, non-exclusive, royalty-free licence to store, process, and display Your Content solely for the purpose of providing the Service to you.

We do not claim any intellectual property rights over Your Content. We do not access, analyse, or use the geometric or manufacturing data in your STEP files for any purpose other than rendering them for you.

You are solely responsible for ensuring you have the right to upload any content you submit. Do not upload files that contain third-party intellectual property you are not licensed to share.

06 — Acceptable use

You agree not to use OnyxCAD to:

— Upload content that infringes the intellectual property rights of any third party.
— Attempt to reverse-engineer, scrape, or extract data from the Service beyond normal use.
— Use the Service to distribute malware or malicious files.
— Attempt to gain unauthorised access to other users' accounts or data.
— Use share links to distribute content to parties not authorised to receive it under your own obligations.
— Circumvent subscription limits through automated means.
— Use the Service in any way that violates applicable law.

We reserve the right to suspend or terminate accounts that violate these rules without notice or refund.

07 — Share links and third-party access

When you generate a share link for a project, that link allows any person with the URL to view the annotated model in a browser without an OnyxCAD account.

You are solely responsible for:

— Controlling who you share links with.
— Ensuring the content you share does not violate any export control regulations, confidentiality obligations, or third-party rights.
— Revoking share links when they are no longer needed.

OnyxCAD does not verify the identity of anyone accessing a share link. We are not liable for any consequences arising from your decision to share a link with any particular person or organisation.

When you archive a project, its share link is automatically paused and inaccessible until you restore the project to active status.

08 — Data deletion

You may delete individual projects or your entire account at any time from within the OnyxCAD application.

— Deleting a project permanently deletes the associated STEP file and all annotation data from our servers. This action is irreversible.
— Deleting your account permanently deletes all your projects, files, annotations, and account data. This action is irreversible.
— Payment records are retained for 7 years as required by UK financial record-keeping law, even after account deletion.

We are not responsible for any loss arising from your deletion of content.

09 — Disclaimer of warranties

OnyxCAD is provided "as is" and "as available" without warranty of any kind, express or implied.

We do not warrant that:

— The Service will be uninterrupted, error-free, or available at any particular time.
— The Service will meet your specific engineering or manufacturing requirements.
— Annotations, tolerances, or other data created using OnyxCAD are suitable for use in manufacturing, certification, or safety-critical applications without independent verification.

OnyxCAD is a documentation and communication tool. It is not a substitute for professional engineering review. You are solely responsible for verifying the accuracy and appropriateness of any specifications before use in manufacturing.

10 — Limitation of liability

To the maximum extent permitted by the laws of England and Wales, OnyxCAD shall not be liable for:

— Any indirect, incidental, consequential, or special damages arising from your use of the Service.
— Any manufacturing defects, production errors, or financial losses arising from reliance on annotations, tolerances, or specifications created using OnyxCAD.
— Loss of data resulting from your own deletion actions or from factors outside our reasonable control.
— Any losses arising from unauthorised access to your account due to your failure to maintain secure credentials.

Our total liability to you for any claim arising from use of the Service shall not exceed the total amount you paid to us in the 12 months preceding the claim.

11 — Changes to the service and these terms

We reserve the right to modify or discontinue the Service or any feature at any time, with or without notice. We will make reasonable efforts to notify users of significant changes via email or in-app notification.

We may update these Terms from time to time. Material changes will be notified by email or prominent notice on the site at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
